Youtube-dl is a legitimate tool with a world of a lawful uses. Demanding its removal from Github is a disappointing and counterproductive move by the RIAA.

Isn't DMCA takedown meant for if the content itself is a violation of copyrights? Therefore, it would be appropriate to issue a DMCA takedown if youtube-dl itself was stolen from RIAA, but not for this. Am I right?

@nighthacker2003 @eff no, copyright law covers actual infringement. The DMCA "criminalizes production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works (commonly known as digital rights management or DRM). It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself." (From wikipedia)

@nighthacker2003 basically, the DMCA makes it criminal to break any digital lock, regardless of how effective it is. It's a terrible thing for the world. That said, youtube-dl didn't help themselves by giving specific infringement instructions against RIAA owned media.

I agree that DRM is evil and that breaking it shouldn't be a crime. But how loose is their definition of a digital lock? As far as I can tell, Youtube has no locks, unless they count not explicitly including a "download" button as a lock.

@nighthacker2003 @eff It's not a copyright infringement takedown, it's a business model enforcement infringement takedown, which is even more sinister:…

@eff "the source code expressly suggests its use to copy and/or distribute the following copyrighted works" - If this is the case, then they gave the stick to the RIAA 😕

@eff Six days ago I hatched a plan to create a permissionless, p2p, e2e encrypted alternative to github and began researching and discussing. Got lots of support, including two offers of help from the #foss community.

Yesterday the #RIAA and #github censored the #YouTubeDL repo. That will not be possible with Safe-git, no servers, no server owners.

Here's the plan:

@happybeing @eff Very intriguing concept, this is the way forward! Let's make sure this move by the copywrong #MAFIAA backfires and actually spurs decentralization and innovation.

@quincy @eff glad you agree 🙂.

Servers are a fundamental weakness so we need to provide systems that aren't dependent on them.

Not many people get that or can see how to achieve it, but it's what we need and what Safe Network is doing.

@happybeing @eff Absolutely. And this is true of all modes of collaboration. Instant messaging, forums, video calls, ... and source control. Whatever can be done without a central server, should be done without a central server!

@happybeing @eff I may just be out of touch but what is the RIAA?

github is microsoft : easy to ask for suppression.

runaway from github

@eff I think it's a good new for helping getting FOSS projets away from Github.

@xs @eff This project needs to get away from US and EU hosting.
