…More significantly, if the #Trump admin can defy court orders with impunity, & #Congress is unwilling to act, there is no reason for it to respect the constitutional rights of American citizens either. The Roberts Court will now have to decide whether to side with the #Constitution or with a #lawless president asserting the power to disappear people at will. This is not a power that any person, much less an American president, is meant to have.

In this prerogative state, #judges & other legal actors deferred to the #racist hierarchies & ruthless expediencies of the #Nazi regime.

The key here is that this prerogative state does not immediately & completely overrun the normative state. Rather, Fraenkel argued, #dictatorships create a #lawless zone that runs alongside the normative state. The 2 states cohabit uneasily & unstably. On any given day, people or cases could be jerked out of the normative state & into the prerogative one.

Even as evidence emerges of potentially grave errors in their vetting process, the Trump admin appears ready to argue -they can use the Alien Enemies Act to enter the home of any person they allege is a member of Tren de Aragua, W/O A WARRANT.

Experts say such an interpretation would infringe on basic civil liberties -raise the potential for misuse. Warrantless entries: some precedent in wartime history -not in peacetime.
