Each justice would be required to publicly release their opinions & disclose how they voted on issues considered on an emergency basis, sometimes referred to as the #ShadowDocket. Such decisions, which have become more common & increasingly controversial in recent years, don’t identify how each justice voted.

It would require the #IRS to initiate an #audit of the justices’ tax returns each year, release the results & make the tax filings public. Nominees to the court would have to disclose 3 yrs of tax returns.

Another measure would allow a two-thirds vote of the court to force a fellow justice to #recuse from a case.

The #legislation would also require #SCOTUS nominees to be automatically scheduled for a vote in the #Senate if their nominations have lingered in committee for >180 days.

The measure would prevent senators from blocking a president’s nominees by refusing to hold a vote on them, as then-Senate Majority Leader #MitchMcConnell (R-KY) did after President Barack #Obama’s nomination of #MerrickGarland in 2016.

But in practice, they are also constrained by norms & conventions. Since the early 20th century, for instance, #Congress has not dissolved #FederalCourts whose #judges displease it—which did happen in the more distant past. The idea of #CourtPacking has been considered out of bounds ever since #FDR tried & failed to reshape #SCOTUS in the 1930s by proposing to appoint up to 6 additional justices.

In Dec 1761, King George III dispatched an order to the American colonies. In a recent defiance of convention, some American colonial #judges had been appointed for life, the same tenure that British judges enjoyed. Now the #king intended to make it clear that all colonial judges were to serve only “at the pleasure of the crown.”

Only after a public trial with a full defense and appeals (or whatever high bar they wanted).

Of course, nothing would stop a Red state from trying to do that anyway. I have zero faith that the SCOTUS would be consistent if the case benefited the Republican candidate.

I can easily see Texas passing a law based on that Const provision to bar "enemy" Harris in 2028 (with no trial)...and the SCOTUS allowing it.
