I filed the Notice of Appeal to the 9th Circuit, and for now paid the fees on my Apple Card (the only card not maxed out yet, also kinda poetic).
10/1 Notice of Appeal:

I still need to fundraise for the $605 fee though. Please donate if you can!

Just to be clear, the lawsuit was not dismissed completely.
There were still many claims left, and most that were dismissed were given leave to amend.
However, we're fighting for justice. Justice means all meritorious claims should go forward. So, 9th Circuit, here we come!
The two claims dismissed with prejudice that are hills I'd die on are ultrahazardous activity (fab) and Cal. Labor Code § 6399.7 (Right to Know / HAZWOPER retaliation). He said they're dismissed and I can't even try to amend. That's unacceptable.

I wonder how much crApple is paying the judge...
@ashleygjovik
You don't need to reply. This is merely an internet comment and in no way shape or form a legal concern, wink wink.
@drakenblackknight Apple's so cheap, they definitely seem more likely to threaten Judges then pay them.

The first and last time I ever went to a crApple store the battery on my iPhone 6 was swollen. They refused to touch it and instead offered to sell me the latest and greatest iToy at full price.
On Friday I went to the Google store in Manhattan to get the battery on my Pixel 6a replaced and, after taxes, it cost me just under $75. The receipt even explicitly said "out of warranty" and they still fixed it. Feels as brand new as a 2 year old phone can get.
I'm sticking with Pixels

That story right there should tell you that I know how many pennies crApple pinches.
